BASIC FACTS OF THE CASES (more than one) (check video, Link 1, Link 2, Link 3) Slavery wasn't leagaly established in Kansas and segragation was more loose than in other southern states. The state had segragated schools till th NAACP challanged it, so Kansas integrated black and white schools. This was judicial turning point because it strengthend the arguement for eqaul rights and the 14th amendment.
MAIN ARGUMENTS OF THE PLAINTIFF (for integration) (check Link 1) The arguments of the Plaintiffs were legal, historical and phsychological.
They argued that in he Plessy V. Ferguson case the supream court misenterpreted the equal protection clause of the 14th amendment and that it didnt allow segragation. They argued that the the 14th amendment said government could prohibit discrimination. They went on to say that the 14th amendment didn't say if states could segragate education. They also believed that it was physchologicaly damaging to segragate children.
MAIN ARGUMENTS OF THE DEFENDANTS (for segregation) (check Link 1)
The Defendants had four arguements. One the government didn't require blacks and white to go to the same schools. Two Segragation was a regional custom and the states should be aloud tohandle their own affairs. Three segragation was not harmful to black people. Finally four the whites were trying hard to equalize the schools and that because of slavery it would take a while for the black kids to compete with the white kids.

The judges started out skeptical of integration. Could they enforce it, but when Vinson died and Earl Warren took his place the decision was unanimous. They over turned Plessy.

Segregation of white and colored children in public schools has a bad effect upon the colored children. The when it has the law's support its worse, separating the races says that whites are better than African Americans. We decided that in public schools the doctrine of ‘separate but equal’ has no place. Separate schools are unequal.
